YellCast™ End User License Agreement (EULA)

YellCast is a instant messaging system which lets superevisors transmit messages to the workforce, and to let higher level management send messages to the managers controlling work teams. It is not a chat system; rather it is a specialized messaging system intended to facilitate the management of workgroups, by assisting the managers in informing workers as they perform their tasks. As such it is a useful tool in the arsenal of tools available to help you to succeed in your business venture. It is COPYRIGHT2007 by Kirk D Bailey, hereafter referred to as 'the owner'. This EULA sets forth the terms and conditions of licensing you toposess and use this software.

LICENSE
The Owner hereby gives you a non-exclusive license to use the software at one site; such use will include work at home employees 'telecommuting' to work at that site via remote login. Additional sites may be licensed for a smaller additional fee as detailed below. By using this software the user agrees to pay the license fee and agrees to the terms of the license. If these terms are not acceptable, do not use the software.

You may:

• - use the Software on any number of computers at one site, unless additional site licenses are purchased;
• - Modify the forms, menu(s) and script program to customize the inistallation of the software to your needs. this does not break copyrights, and the modified software remains property of the copyright holder, and may not be shared, given, rented, or sold to any party extermal to participating in this license whatsoever.
• - copy the Software for archival purposes, provided any copy contains all of the original Software's proprietary notices.

You may not:

• - permit other individuals to use the Software except under the terms listed above;
• - modify, translate, reverse engineer, decompile, disassemble (except to the extent applicable laws specifically prohibit such restriction) other than in the manner permitted in this license to custom inistall the software to your needs;
• - create derivative works based on the Software;
• - copy the Software (except as specified above);
• - rent, lease, transfer or otherwise transfer rights to the Software;
• - or remove any proprietary notices or labels on the Software.

TERMINATION.
The license will terminate automatically if you fail to comply with the limitations described above. On termination, you must destroy all copies of the Software and Documentation.

JURISDICTION
This EULA is a contract between The Owner and the licensee of this software, and shall be ajudicated in the courts of Florida under the laws thereof if need be.

DISCLAIMER OF WARRANTY

The Software is provided on an AS IS basis, without warranty of any kind, including without limitation the warranties of merchantability, fitness for a particular purpose and non-infringement. The entire risk as to the quality and performance of the Software is borne by you. Should the Software prove defective, you and not the copyright owner assume the entire cost of any service and repair.

THE OWNER IS NOT RESPONSIBLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES.

Title, ownership rights and intellectual property rights in and to the Software shall remain in The Owner. The Software is protected by international copyright treaties.

For 1 site-$99.95	Multiple ajacent buildings is one site.
per + site:$20	Sites in addition to the first.

YellCast&trade, the trumpet.py program, and The YellCast System™ are ©2007 BY KIRK D BAILEY, and is only available under the terms of this license. 'YellCast™' is a REGISTERED TRADEMARK owned entirely by Kirk D Bailey.
